Timothy M. Cary is a seasoned attorney who manages Timothy M. Cary & Associates and offers specialized expertise in the representation of public entities and school districts. His experience includes employee discipline and release; certificated and classified layoff proceedings; labor arbitrations and grievances, including unfair labor practice proceedings before PERB; labor negotiations including impasse mediation; administrator contract negotiations; procurement and public bidding issues; government contracts; construction disputes and litigation; facilities construction issues; real property acquisition; defense and resolution of DFEH complaints; board policy analysis and drafting; workers’ compensation issues; personnel and public records issues; workplace violence injunctions; and legislative analysis.
Most recently, Mr. Cary has been the lead attorney in recovering millions of dollars for a public school district from its defunct construction management company in the context of complex civil and bankruptcy litigation. The dispute involved complex issues revolving around construction bonding requirements in public works contracts, breach of contract disputes and professional negligence claims.
Prior to forming the firm of Timothy M. Cary & Associates, Mr. Cary was an associate with Downey, Brand, Seymour & Rohwer (now Downey Brand, LLP) in Sacramento. Prior to that, Mr. Cary was an associate attorney with the worldwide law firm Gibson, Dunn & Crutcher.
Mr. Cary has many years of experience with governmental programs and contracting efforts, having served as a Management Analyst for the United States General Accounting Office in Washington, D.C. He worked on special projects pertaining to governmental budgeting issues, and was responsible for auditing entities such as the National Highway Traffic Safety Agency and the U.S. Department of Commerce. Mr. Cary also served as a U.S. Peace Corps Volunteer in the Republic of the Philippines from 1980 to 1982.
Adding to his perspective on employment litigation and public entity representation, Mr. Cary was the senior member of the Buckeye Union School District Board of Trustees, where he served from 1990 to 2002. In his position as an elected school board trustee, Mr. Cary was integrally involved in employment issues, labor negotiations, and an active facilities construction program. In 2002, Mr. Cary was appointed to the El Dorado Union High School District Board of Trustees, was elected to a new four-year term in November, 2002, and recently elected to another four-year term in November, 2006. Mr. Cary is currently the Board President for the El Dorado Union High School District. Mr. Cary is also a long-time elected representative to the El Dorado County Committee on School District Organization.
